Transparency in AI use.
The Bom Dia Creation™ AI Policy distinguishes legal obligations from the agency's voluntary standard. Article 50 AI Act covers the uses it specifies and, under Article 113, applies from 2 August 2026. AI-assisted editing does not in every case trigger a labelling obligation. Bom Dia Creation™ nevertheless applies its own broader transparency standard and retains human editorial responsibility.
Content labelling. The notice in the footer is Bom Dia Creation™'s voluntary transparency standard, not a statement that every page is subject to the labelling obligation in Article 50. We apply additional labelling to synthetic or manipulated content where required by law and by the nature of the material.
AI as an author's assistant. A named editor at Bom Dia Creation™ is accountable for every final piece of content. AI-generated artefacts undergo editor validation before publication or delivery to a client.
Brand context. When working with a client, AI systems operate in the context of their Bom™ system (tone of voice, archetype, brand strategy).
Personal data. By default, we do not provide personal data or confidential client materials to external AI tools. Any other use requires an agreed legal basis, purpose, approved environment and scope.
Automated processes. The calibrator structures the answers and proposes a first step. It does not send data to the website's server, enter into a contract, set a price or availability, or produce legal or similarly significant effects. It does not constitute automated decision-making within Article 22 of the GDPR.
ISO/IEC 42001. The standard ISO/IEC 42001 serves as an organisational reference for managing the use of AI. Bom Dia Creation™ does not claim certification or that a certification process has begun.
Data under control.
Data controller. Bom Dia Creation, Unipessoal Lda, a company incorporated under Portuguese law. Company formation entry dated 1 April 2024. Headquarters: Rua Coronel Figueiredo, Lagoa Business Centre, Loja 5, 8400-306 Lagoa, Portugal. NIPC and tax identification number: 518 102 939, VAT number: PT518102939. Data processed and how the forms work. The contact-form and calibrator fields are processed locally in the browser solely to prepare a draft email. The website code neither sends nor stores their contents on a server. Data reaches Bom Dia Creation™ only when the user sends the prepared message from their email application or writes through a chosen channel such as WhatsApp. During an engagement, we also process contact-person details, project correspondence and billing data. The Sites hosting and security provider may process technical connection data required to deliver and secure the service.
Purposes and lawful bases. Each purpose has a separate basis, so the scope of processing remains verifiable.
Service providers and data audiences. The website runs on OpenAI Sites, while email is provided by Zenbox. Accounting services are provided by Elan in Portimão. In our professional work we may use services from Anthropic, OpenAI, Google, Adobe and Fireflies, as well as Google Workspace. Each provider's role, the permitted data scope and the basis for using the service depend on the particular process, contract and account configuration. Access to a project space is set according to the engagement and each person's role; we do not automatically grant full editing rights across the agency's entire drive.
Delivery partners. Where a scope involves an ecosystem partner, we provide that partner only with the data necessary to deliver its part of the work, under contract and after identifying the arrangement in the delivery proposal.
Transfer outside the European Economic Area. If a particular process transfers data outside the EEA, we check the applicable transfer mechanism before using the service. Depending on the provider and place of processing, this may be an adequacy decision, Standard Contractual Clauses or another mechanism under Chapter V of the GDPR, together with supplementary safeguards where required.
Working with AI tools. Before using client materials, we check the service terms, account settings and permitted scope. Only material required for the agreed purpose and permitted by the contract and the client's decision is provided to the tool. Every output is reviewed by the responsible editor.
Your rights. You have the right to access, rectify and erase your data, restrict processing, receive your data in a portable format and object to processing based on legitimate interests. Where processing is based on consent, you may withdraw it without affecting the lawfulness of earlier processing. Send your request to weare@bomdiacreation.com and we will deal with it without undue delay, normally within one month.
Complaint to the supervisory authority. The supervisory authority responsible for the controller is Portugal's Comissão Nacional de Proteção de Dados (CNPD). People in another EU Member State may also lodge a complaint with the data-protection authority in their country.
Security. Only people who need it to perform the scope have access to the data.
Providing data. Providing data is voluntary. The information required depends on the channel selected: an email address is needed only if the reply is to be sent by email. The form can prepare a message without completing optional fields.

Principles of collaboration.
§1 · Service Provider. These Terms govern use of the bomdiacreation.com website and the provision of services by Bom Dia Creation, Unipessoal Lda with its registered office: Rua Coronel Figueiredo, Lagoa Business Centre, Loja 5, 8400-306 Lagoa, Portugal, NIPC 518 102 939, VAT PT518102939. Our services are addressed to entrepreneurs and organisations; the collaboration is of a professional nature between the parties running the business.
§2 · Concepts. Offer register means the canonical catalogue of services and products published in the Public Practice & Offer Library, which is linked from the Offer page. Calibration means a conversation or form leading from a client's situation to a scope recommendation. Delivery proposal means the document that sets out the binding scope, fee, schedule, roles and handover terms. Source of truth means the engagement documentation containing the record of decisions, versions and agreements.
§3 · Nature of the website content. The website content is provided for information and invites a conversation about a potential engagement. The binding scope, fee and schedule are set out in a delivery proposal prepared after the calibration conversation. The calibrator recommends a first step; the client and consultant agree the scope together.
§4 · Entering into an engagement. The process may begin with the online calibration, a request for a conversation, an email or WhatsApp. The website forms prepare a draft in the user's email application and do not themselves place an order. A delivery proposal is prepared after the calibration conversation. A contract is formed when that proposal is accepted in documentary form, including by email. Where the delivery proposal and these Terms differ, the delivery proposal prevails for that engagement.
§5 · Fees and payment. Amounts shown on the website or in the Public Practice & Offer Library are net amounts in EUR and may be subject to tax according to the place of supply. A price is binding only where a particular entry expressly says so or it has been confirmed in the delivery proposal. The website does not process payments or form contracts directly. The delivery proposal specifies payment dates, the settlement currency and any instalments; invoices are issued under Portuguese law.
§6 · Workflow. Each scope has a mandate: the purpose of the decision, roles, decision authority, advisory contribution, delivery responsibility and approval path. Documentation may be maintained in a Google Workspace space created for the engagement. Access and editing rights follow each person's role and the project arrangements. Agreements and decisions are recorded in the source of truth together with their version, owner and date.
§7 · Customer's materials. Materials supplied by the client remain the client's property. The client confirms that it holds the necessary rights to those materials; we use them only to the extent required to provide the service.
§8 · Deliverables and intellectual-property rights. Each scope ends with ready-to-use material and a record of decisions in the source of truth. Any assignment of economic copyright or grant of a licence, including the rights and permitted uses covered, takes effect on the terms set out in the delivery proposal after payment for the relevant scope. We obtain the client's consent before presenting completed work in the agency portfolio.
§9 · Partners and AI tools. Some of the scope may be performed by an ecosystem partner; the partner's participation and role are indicated in the delivery proposal, and responsibility for the result remains with the agency. Working with AI tools is carried out in accordance with the principles of the AI Policy from the first point of this page: each result has a responsible editor, and personal data remains outside external AI tools without express consent.
§10 · Confidentiality. Each party will keep confidential any information about the other party's situation, plans and data obtained through the engagement, including after the engagement ends. Access to the documentation is limited to people involved in the relevant scope.
§11 · Liability. We will perform each scope with due professional care. Our aggregate liability for a scope is limited to the fee paid for that scope, except where liability cannot lawfully be limited, including in cases of wilful misconduct. Deadlines will be extended for events beyond the parties' reasonable control, provided the other party is notified.
§12 · Enquiries and complaints. Service and engagement enquiries can be sent to weare@bomdiacreation.com. We acknowledge complaints within 2 business days and respond within 14 calendar days. If a case requires more time, we explain why and provide a specific date for the next response. A complaint should describe its scope, the concern and the expected resolution.
§13 · Applicable law and disputes. These Terms are governed by Portuguese law. The parties will first seek to resolve disputes through discussion and mediation. Unless mandatory law provides otherwise, the courts with jurisdiction over the service provider's registered office will have jurisdiction.
§14 · Changes to the Terms. Version dated 13 September 2026, effective upon publication on bomdiacreation.com. Engagements begun earlier remain subject to the accepted delivery proposal and the applicable version of the Terms.
